1. Agreement to Terms
By accessing or using the website, patient portal, forms, communication tools, or services of Nebraska Peace of Mind Behavioral Health, LLC (“NPM,” “we,” “our,” or “us”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms, you may not use our website or services.
These Terms apply to all users, including patients, prospective patients, website visitors, guarantors, parents or legal guardians of minor patients, and any individuals interacting with our services.
2. Nature of Services
Nebraska Peace of Mind Behavioral Health, LLC provides outpatient behavioral health services, including but not limited to psychiatric evaluation, medication management, psychotherapy, care coordination, and related support services.
Services may be delivered in person, by telehealth, by phone when clinically appropriate, or through other approved communication tools. Clinical services are provided by licensed professionals affiliated with NPM, including independent contractors and employees, who exercise independent clinical judgment.
3. No Emergency Services
NPM does not provide emergency or crisis response services through its website, text messaging, email, patient portal, or standard phone lines.
- If you are experiencing a medical emergency, call 911 immediately.
- If you are experiencing a mental health crisis, call or text 988 or go to the nearest emergency room.
- Do not use website forms, standard text messages, voicemail, email, or portal messaging for urgent or emergent concerns.
4. Eligibility
You must be legally permitted to consent to services in the applicable jurisdiction. If services are requested for a minor, the parent or legal guardian submitting information or consent represents that they have authority to do so.
You agree that all information you provide to us is accurate, current, and complete.
5. Patient Responsibilities
By engaging in services, you agree to:
- Provide accurate demographic, clinical, insurance, and payment information
- Update us promptly if your contact information, insurance, or legal status changes
- Attend scheduled appointments or provide timely cancellation notice
- Participate honestly and appropriately in care
- Follow office policies, financial policies, and safety expectations
6. Appointments, No-Shows, and Late Cancellations
Appointments should be canceled at least 24 hours in advance unless a stricter timeframe is stated in a separate office or financial policy.
- Late cancellations and missed appointments may result in a fee
- Repeated no-shows or late cancellations may result in reduced scheduling access or discharge from care
- Future appointments may be canceled if required balances are not addressed under our financial policies
7. Payment, Insurance, and Financial Responsibility
You are financially responsible for all services rendered, including co-pays, deductibles, coinsurance, balances applied to patient responsibility, non-covered services, and claims denied after processing.
- Payment may be due before or at the time of service
- A valid payment method may be required on file
- Outstanding balances may be charged in accordance with signed financial consents and applicable law
- Delinquent balances may affect scheduling and continuation of non-emergency services
8. Insurance and Billing Disclaimer
Insurance verification is not a guarantee of payment. Coverage determinations are made by your health plan. You remain financially responsible for amounts not paid by your insurer, including denials, downcoding, coordination of benefits issues, retroactive eligibility changes, recoupments, and non-covered services.
NPM may use third-party billing vendors, clearinghouses, and payment processors to support operations.
9. Telehealth Services
By participating in telehealth services, you acknowledge that telehealth has limitations and risks, including potential technical failures, privacy limitations, and interruptions beyond our control.
- You are responsible for using a private and secure environment when possible
- You must be physically located in a jurisdiction where your provider may lawfully render services at the time of the appointment
- We may discontinue or reschedule a telehealth session if identity, safety, technology, or legal concerns arise
10. HIPAA and Privacy
Protected health information is handled in accordance with applicable federal and state privacy laws, including HIPAA where applicable. Please review our Notice of Privacy Practices and Privacy Policy for more details regarding how information is used, disclosed, and safeguarded.
While we take reasonable steps to protect electronic communications, no method of transmission or storage is completely secure.
11. SMS/Text Messaging and TCR Compliance
By voluntarily providing your mobile phone number and opting in through our website forms, intake documents, patient communications, or other written consent methods, you expressly agree to receive text messages from Nebraska Peace of Mind Behavioral Health, LLC for purposes that may include:
- Appointment reminders and scheduling communications
- Operational or administrative updates
- Billing notifications and account-related messages
- Care coordination messages when appropriate
Message frequency may vary depending on your relationship with our practice, your care needs, and your account activity. Message and data rates may apply.
You can opt out of SMS messages at any time by replying STOP. For help, reply HELP or contact our office directly. Opting out of text messaging may affect our ability to provide you with convenient appointment reminders or operational updates, but will not affect your ability to receive care by other reasonable methods.
Consent to receive text messages is not a condition of purchase or treatment. You represent that the mobile number you provide belongs to you or that you are authorized to provide that number and receive messages at that number.
We do not sell, rent, or share your mobile phone number or SMS consent information with third parties or affiliates for their own marketing or promotional purposes. We may use service providers that help us deliver messaging and related business operations, subject to applicable confidentiality, privacy, and legal obligations.
12. Website Use
You agree not to use this website in any way that is unlawful, disruptive, fraudulent, abusive, or harmful. You may not attempt to gain unauthorized access to any part of the website, interfere with site operations, or introduce malware or malicious code.

13. Intellectual Property

14. Independent Providers and No Guarantee of Outcomes
Providers affiliated with NPM exercise independent professional judgment. We do not guarantee specific treatment outcomes, medication responses, symptom improvement, or results from any service.
15. Limitation of Liability
To the fullest extent permitted by law, the website and related non-clinical digital services are provided “as is” and “as available.” NPM disclaims warranties of any kind except where such disclaimers are prohibited by law.
To the fullest extent permitted by law, NPM shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to use of the website, messaging systems, or non-emergency communications tools.
16. Indemnification
You agree to indemnify and hold harmless Nebraska Peace of Mind Behavioral Health, LLC, its owners, affiliates, providers, workforce members, contractors, and agents from claims, losses, damages, liabilities, and expenses arising from your misuse of the website or services, your violation of these Terms, or your provision of inaccurate or unauthorized information.
17. Termination of Services
We reserve the right to suspend or terminate access to website functions, communication tools, or non-emergency services as permitted by law and professional standards, including for non-payment, repeated missed appointments, fraud, misuse, unsafe behavior, harassment, or violation of office policies.
Clinical discharge, when applicable, will be handled in accordance with professional, ethical, and legal requirements.
18. Third-Party Services
Our website and operations may rely on third-party vendors and platforms, including but not limited to website hosts, form tools, telehealth systems, EHR systems, billing vendors, and payment processors. We are not responsible for the independent policies, outages, or security practices of third-party services outside our reasonable control.
19. Governing Law
These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles, except to the extent superseded by applicable federal law.
20. Dispute Resolution
Any dispute arising from or relating to these Terms or use of the website shall first be addressed through good-faith efforts to resolve the matter informally. If unresolved, the dispute shall be handled in Lincoln, Nebraska, through binding arbitration to the extent enforceable under applicable law, unless another dispute process is required by law or separately agreed in writing.
Nothing in this section prevents either party from seeking temporary injunctive or equitable relief where appropriate.
21. Changes to Terms
